Privacy Policy

This policy covers Lemmy Adam LLC (“we”, “us”), our websites lemmyadam.com and echoplasm.lemmyadam.com, and our software, including Echoplasm. It explains what personal information we collect, why, who else handles it, and what you can ask us to do with it.

The short version: we collect as little as we can. Our websites have no analytics, no advertising and no tracking cookies. When you buy, our store partner Moonbase handles the payment. We never see your card details, and we never sell your information.

Who we are

Lemmy Adam LLC is a limited liability company in Nebraska, United States. We are responsible for (the “controller” of) the personal information described here, except where we say that Moonbase is. You can reach us at [email protected].

What we collect, and why

When you visit our websites

Our sites are plain web pages. They don’t use analytics, advertising or tracking cookies, and they don’t ask for any information.

Like every web server, our hosting provider (DigitalOcean) briefly records technical details of each request, such as your IP address, the page asked for, the time and your browser’s user agent. These logs are used only to keep the sites running and secure, and are deleted automatically.

The store, account and activation pages include parts provided by Moonbase (see below). Those parts may use cookies or similar storage that are needed for your cart, sign-in and checkout to work.

When you buy

Purchases are made through Moonbase, which acts as the merchant of record: Moonbase is the seller in the transaction, takes the payment, and handles sales tax and VAT. To do this, Moonbase collects your name, email address, billing country and address, and payment details. Payment card details are handled by Moonbase’s payment processors; we never receive them.

Moonbase shares with us what we need to serve you as a customer: your name, email address, country, what you bought, when, and the price paid. We use this to deliver and support your licence, to put right billing mistakes, and to keep the business and tax records the law requires.

When you activate and use our software

Echoplasm needs a licence to run beyond its trial. When you activate, check or deactivate a licence (or start a trial), the plugin connects to Moonbase and sends:

  • your licence or trial details, and the account it belongs to;
  • an identifier for your computer, made from details of the machine, so a licence can be limited to a number of computers;
  • your computer’s name and operating system, so you can tell your activated computers apart in your account;
  • the plugin’s version.

Once a day at most, when its window opens, the plugin also checks for a newer version by downloading a small file from lemmyadam.com. That request sends nothing about you or your computer; like any web request, our hosting provider sees your IP address in its logs (see above). You can turn this off in the plugin (the Echoplasm menu → Check Automatically).

The plugin doesn’t send your audio, your projects or settings, or statistics about how you use it. Apart from licensing and the update check, it doesn’t connect to the internet.

When you contact us

If you email us, we receive your email address and whatever you choose to tell us, and we use it to answer you. Our email is provided by Google Workspace.

Email updates

We don’t send marketing email. If we start a newsletter, it will be opt-in only, and you can leave it at any time. Moonbase sends transactional email about your purchase (receipts, download links, licence information) on our behalf.

  • Performance of a contract: to sell, deliver, license and support the software you bought or are trying.
  • Legal obligation: to keep tax and accounting records.
  • Legitimate interests: to keep our websites and licensing secure, to prevent piracy and fraud, and to answer messages you send us.
  • Consent: for any optional email we might send in the future. You can withdraw consent at any time.

Who else handles your information

We use a small number of service providers (“processors”), and only for the purposes above:

As merchant of record, Moonbase is also responsible for the information it needs to take payments and meet its own legal duties, under its own privacy policy.

We don’t sell or rent personal information to anyone, and we don’t share it for advertising. We may disclose information if the law requires it, or to protect our rights (for example, against piracy or fraud). If Lemmy Adam LLC or a product is ever sold or merged, customer records would pass to the new owner under this policy.

International transfers

We are in the United States, and our providers may process information in the United States and other countries. Where the law requires it, transfers are covered by appropriate safeguards, such as the European Commission’s standard contractual clauses.

How long we keep it

  • Purchase and licence records: for as long as your licence exists, so you can keep downloading and activating what you bought, and then as long as tax and accounting law requires (usually up to 7 years).
  • Support emails: up to 3 years after the conversation ends, unless we need them longer for a dispute.
  • Web server logs: a short time (typically up to 30 days).

Your rights

Depending on where you live, you may have the right to ask us for a copy of your personal information, to correct it, to delete it, to restrict or object to how we use it, and to receive it in a portable form. To use any of these rights, email [email protected] from the address you bought with. We’ll answer within 30 days. Some records (such as tax records) we have to keep even if you ask us to delete them, and deleting your account means your licences can no longer be used.

If you’re in the EU or UK and unhappy with how we’ve handled your information, you can complain to your local data protection authority.

California residents: we don’t sell or share personal information as those terms are defined in California law, and we don’t use it for targeted advertising.

Children

Our websites and software aren’t aimed at children under 16, and we don’t knowingly collect information from them.

Security

We use providers with strong security practices, keep access to customer records to ourselves, and use encrypted connections (HTTPS) on our websites and for licensing.

Changes

If we change this policy we’ll update the date at the top. If a change is significant, we’ll say so on this page and, where appropriate, email customers.
